Type of Permission Granted

 

What Type of Permission will be Given

The type of permission given to a successful Applicant will depend on the status of the Sponsor.  In a case where the application is granted the following types of permission may be given for one year.  Instructions for renewal will be contained in the permission letter.

 

Sponsor - Irish National

If the Sponsor is an Irish National a successful Applicant may be granted one year on Stamp 4.  This stamp 4 exempts the Applicant from the need to have an Employment Permit or Business Permission.

 

Sponsor - Employment Permit Holder – Stamp 1, Resident in State before 30 June 2009

If the Sponsor is a Employment Permit holder on a Stamp 1 and resident in the State since before 30 June 2009 the successful Applicant may be granted a Stamp 3.  Should permission to remain be granted on this basis, it does not exempt the person from employment permit requirements.  In order to take up employment in the State, the Applicant must be in possession of an Employment Permit.  This Stamp 3 will allow the Applicant to apply for a Dependant Employment Permit with the Department of Jobs Enterprise & Innovation. 

When applying for a Dependent Employment Permit with the Department of Jobs Enterprise & Innovation the Applicant must enclose the permission letter issued by the Irish Naturalisation and Immigration Service confirming the immigration status based on the de facto partnership.

 

Sponsor - Employment Permit Holder – Stamp 1, Resident in State after 30 June 2009

If the Sponsor is an Employment Permit holder on a Stamp 1 who came to live in Ireland after 30 June 2009 the successful Applicant may be granted a Stamp 3.  This Stamp 3 does not allow the Applicant to work in the State and it will not allow the Applicant to apply for a Dependant Employment Permit.  If the Applicant wishes to work they will have to apply to the Department of Jobs Enterprise & Innovation for an Employment Permit in their own right.

 

Sponsor Stamp 4 and 5

If the Sponsor is resident in Ireland on a Stamp 4 or 5 the successful Applicant may be granted a Stamp 3.  This Stamp 3 does not allow the Applicant to work in the State and it will not allow the Applicant to apply for a Dependant Employment Permit unless the Sponsor previously held an Employment Permit.  If the Applicant wishes to work they will have to apply to the Department of Employment Jobs & Innovation for an Employment Permit in their own right.
